Algerian Patients Seek Compensation for Medical Errors in Tunisia Under New Law

· Source: Algeria Now

A new Tunisian law, Law No. 2024-32 enacted on 19 June 2024, reshapes the legal framework for medical liability and offers Algerian patients a clearer path to claim damages after undergoing surgery in Tunisia and experiencing complications upon returning home. The legislation grants patients the right to access and obtain full copies of their medical records, a provision extended to legal representatives and heirs, and introduces an amicable settlement mechanism while preserving the option to pursue court action.

Patients are advised to meticulously reconstruct their medical journey, documenting the initial consultation, diagnosis, tests, the performed operation, and any subsequent complications. A written request to the Tunisian health facility for operative reports, anaesthesia records, test results, imaging, prescriptions and hospitalisation summaries should be sent and retained as evidence. Additional reports generated in Algeria, such as those confirming infection, disability or the need for further surgery, can support the claim by linking the adverse outcome to the original treatment.

The law distinguishes liability based on the professional status of the caregiver. Article 25 holds private clinics accountable for faults committed by their salaried staff, while independent practitioners are personally responsible for their own negligence. Moreover, Articles 23 and 26 extend responsibility to health establishments for damages arising from infections linked to care, equipment or products used during treatment.

To establish a claim, Algerian victims must demonstrate not only that their condition worsened but also that the deterioration stems from a medical error rather than an inherent risk of the procedure. Engaging a medical expert of their choice to interpret the records and assess causality is recommended before initiating either an amicable settlement or legal proceedings in the competent Tunisian courts.
