Algerian State Tightens Control Over Private Schools

On 22 September 2026, the Algerian government issued Executive Decree No. 26‑310, which makes Arabic the sole language of instruction in all private schools, except for foreign‑language classes. The decree, published in issue 71 of the Official Journal, also bans the use of unapproved foreign curricula and teaching materials. Only secondary general and technical programmes may include specialised scientific tracks, and these must be authorised by a ministerial order.

Private schools are required to obtain a performance contract from the competent education authority and to establish pedagogical committees to ensure rigorous assessment and prevent fraud. Activities beyond the curriculum must receive prior approval and remain optional for students.

The decree imposes new administrative, financial and organisational conditions. Founders must be Algerian nationals aged 25 or older, free of any professional misconduct, and must provide a 15 % bank guarantee from a public bank, a safety compliance certificate, a building expertise report and a dedicated commercial register. The founder can no longer serve as the school’s director of education; that role must be held by an Algerian national aged 30 or older with a university licence and at least ten years of teaching experience.

The regulation also requires private schools to enter a written tuition contract with each child’s legal guardian, detailing fees, services such as transport and catering, and other ancillary provisions. The decree aims to standardise curricula across the private sector and to allow inspectors to conduct strict oversight, ensuring equal opportunities for all students regardless of the type of school they attend.
